Lately, I've noticed a trend and heard from other listing agents that many buyers are attending open houses and expressing interest in making offers directly through the listing agent. Frankly, I'm puzzled by this approach. The listing agent has a fiduciary duty to the seller, and while there's a possibility for dual representation, it's ultimately up to the seller to decide. Moreover, the listing agent is unable to share strategic or insider information about the seller's bottom line. While this approach may seem convenient at first glance, there are significant disadvantages that buyers need to consider before proceeding without their own representation. In my view, opting for this route is a risky choice for several reasons.

Advantages of Working with the Listing Agent:

  1. Convenience: Working directly with the listing agent may seem more convenient, as it eliminates the need to find and vet a separate buyer's agent.

  2. Access to Information: Buyers may believe that by working with the listing agent, they'll have access to insider information about the property, giving them an edge in negotiations.

Disadvantages of Going Unrepresented:

  1. Conflict of Interest: The primary role of the listing agent is to represent the seller's interests, not the buyer's. This inherent conflict of interest can put buyers at a disadvantage during negotiations, as the listing agent may prioritize the seller's needs over theirs.
